Privacy Statement

Transparency about how we handle your data is fundamental to the ZANOA experience.

The company ZANOA (legal entity: Gruschka, Kantara & Speidel eGbR, Rathausstraße 65, 12105 Berlin, Germany) operates a mobile application called “ZANOA” (hereinafter “ZANOA app”).

With this Privacy Statement, we explain which data are processed and how they are processed when you use the ZANOA app, register an account and create a profile, or use any other functions of the ZANOA app. In doing so, we fulfill our information obligations pursuant to Art. 13 and 14 of the EU General Data Protection Regulation (GDPR).

II. Personal Data, Purposes, and Legal Basis for Data Processing

1. Personal Data

Definition: Under the GDPR, personal data means any information relating to an identified or identifiable natural person (“data subject”). An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that person.

General use of the app

You can use the ZANOA app without providing any personal data. We do not collect or store any personal data when you simply launch and use the app without logging in or registering. However, like most online services, our servers automatically record certain information to maintain system security and stability. In particular, when you use our app, our hosting server may record your IP address, the date and time of access, the requested URL or resource, the content accessed or actions performed, and other technical information transmitted (such as device identifiers or app version). This information remains anonymous to us – we do not use it to identify you, and it is not linked to your user account. The log data is used solely for technical troubleshooting, security (e.g. defense against attacks), and aggregate usage statistics.

Registration and creating a profile

You may choose to register an account with ZANOA and create a user profile (for example, as an individual user or on behalf of a company). During registration, you decide what information about yourself you wish to share with us and (where applicable) with other users or the public. However, certain mandatory information is required to set up an account so that we can provide you with the app’s core services.

  • To register, we always need at least a username (or your name) and a password. Other mandatory data depend on the type of registration:
    • If you register as a private individual, we require at least your first name and last name, a valid email address, and possibly further contact information such as a phone number. In some cases, we may also require your city or country of residence and/or other basic profile information needed for the app’s functionality.
    • If you register on behalf of a company or organization, we require the name of the company, a contact person’s name, the business address (street, postal code, city, country), a contact email, and a telephone number. We may also ask for the company’s industry or field of business so that your profile can be categorized appropriately.
  • Beyond the mandatory details, you have the option to provide additional information in your profile at your discretion.
    • For individual users: You may add details such as a personal biography or self-description, your skills or special qualifications, relevant education or certifications, links to your social media profiles or website, a profile photo, and any other information that you feel showcases your experience or interests. These fields are completely optional.
    • For company profiles: You may provide information like the year of establishment, the number of employees, a description of your products or services, your company logo, and other relevant business information. This voluntary data can help other users understand what your company does. All such information is optional and can be added or updated at any time.

Profile management & News

Once you are registered, you can add to or update your profile information at any time through the app’s profile settings. You have control over which data you want to share and with whom. In your privacy settings, you can determine which parts of your profile are visible to the general public, which are visible only to other registered members, or which remain private. By adjusting these settings, you decide the level of visibility for your personal data on the platform.

If you register an account, we may occasionally use your email address to send you news about updates, new features, or services of the ZANOA app that we believe may interest you. You can opt out at any time via the unsubscribe link or your account settings.

2. Purpose and legal basis for processing data

We process your personal data only for specific purposes and only where we have a legal basis to do so under the GDPR.

  • Providing our app services (contractual necessity) When you register as a member and provide personal data, we process this data to create your account and profile and to deliver the functions of the ZANOA app to you. This is done on the basis of our user agreement with you (Art. 6(1)(b) GDPR).
  • Guest users and one-time features (legitimate interest) If you provide personal data to us without registering, we process that data to fulfill your request. The legal basis is our legitimate interest (Art. 6(1)(f) GDPR).

If we ever wish to process your personal data for a purpose not described in this Privacy Statement or not obviously related to the original purpose, we will inform you separately and, if required, obtain your consent.

III. Recipients of the Data

Within our company: Your data is accessible only to those members of the ZANOA team who need it to perform their duties in providing the service (principle of least privilege). All staff are bound by confidentiality and data protection obligations.

External service providers (processors): We use external partners to help us operate and provide the ZANOA app effectively (e.g. IT infrastructure, email services). We engage such companies as data processors acting on our behalf, contractually bound under Art. 28 GDPR.

Other users and public visibility: Depending on your settings, some data may be visible to other users or the public. You control this via profile settings.

Integration with partner platforms: Currently, ZANOA does not actively share user data with any partner platforms outside of the app.

No unauthorized third-party sharing: We do not sell or rent your personal data to third-party companies. We will not transmit your information to any third parties except as described above, unless required by law.

International data transfers: We process and store data primarily within the EU/EEA. If we transfer data to third countries (e.g. USA via service providers), we ensure appropriate safeguards (SCCs) are in place.

IV. Storage Duration

We keep your personal data only for as long as it is necessary to fulfill the purposes for which it was collected, or as required by applicable laws.

  • Active account data: Retained as long as your account is active.
  • Account deletion: If you delete your account, we remove or anonymize your data, except where legally required to retain it (e.g. tax records).

V. Your Rights as a Data Subject

You can exercise these rights at any time by contacting us.

Right to Information

Obtain confirmation if data is being processed and access that data (Art. 15 GDPR).

Right to Rectification

Request correction of inaccurate or incomplete data (Art. 16 GDPR).

Right to Erasure

Request deletion of your data under certain conditions (Art. 17 GDPR).

Right to Restriction

Limit the processing of your data in specific scenarios (Art. 18 GDPR).

Right to Data Portability

Receive your data in a structured, machine-readable format (Art. 20 GDPR).

Right to Object

Object to processing based on legitimate interest or for direct marketing (Art. 21 GDPR).

You have the right to file a complaint with a data protection supervisory authority (Art. 77 GDPR).

You can revoke consent at any time (Art. 7(3) GDPR).

VI. Obligation to Provide Data

Using the ZANOA app is voluntary. You are not legally or contractually obliged to provide us with personal data. However, if you wish to register an account or use certain features, providing some personal data is necessary. Without the required data, we will not be able to create an account for you or provide the related services.

VII. Automated Decision-Making and Profiling

We do not use any automated decision-making processes that have legal or similarly significant effects on you. We do not perform any profiling on your data that would produce such effects.

VIII. Internet-Specific Data Processing

1. Cloudflare

We use Cloudflare Inc. (USA) for content delivery and security. Your IP address may be processed by Cloudflare to provide speed and protection against attacks. Cloudflare acts under a Data Processing Addendum with SCCs to ensure GDPR compliance. Legal basis: Legitimate interest (Art. 6(1)(f) GDPR).

2. Third-Party Content

We may integrate third-party content. Your data is transferred to these providers only if you activate the content:

  • Google Ireland Limited.
  • Vimeo.com, Inc.

3. Web Analysis (Analytics)

We use analytics to improve our service. These process pseudonymous data (e.g. truncated IP).

  • Google Ireland Limited. Retention set to ~30 days. Uses SCCs for international transfer.
  • New Relic, Inc. For performance monitoring. Uses SCCs.

We only deploy analytics if you consent (Art. 6(1)(a) GDPR).

4. Advertising

We engage in remarketing and conversion tracking (e.g. Google Ads) to promote ZANOA. We only do this with your consent (Art. 6(1)(a) GDPR).

5. Cookies

We use Essential cookies (no consent required) and Performance/Marketing cookies (consent required). You can manage your preferences in our settings.

IX. Joint Processing in Social Networks

ZANOA maintains profiles on social media (e.g. Facebook, Instagram). When you visit these, we may be joint controllers with the platform (e.g. Meta) regarding "Insights" data (Art. 26 GDPR). Meta is primarily responsible for data subject rights regarding this platform data.

If you communicate with us directly via social media, we process that data based on legitimate interest to respond to you.
